The Official Unsecured Creditors Committee
In May of 1995, The Langhorne Company provided an evaluation of the equity in Stuart Centre, Stuart, Florida and Gateway Shopping Center, Swedesford Road and Valley Forge Road, Chester County, Pennsylvania for the Official Unsecured Creditors Committee vs. Haisfield et al., for the purpose of settlement negotiations or use in future litigation. The valuation estimated amount of equity above existing secured indebtedness.
The properties were retail strip centers that were evaluated from both a physical and financial perspective. The firm evaluated existing income streams, validated lease income and expenses, and determined through actual financials and financial modeling performed by our company, on a capitalized or net present value basis whether or not significant equity could be proven for the committee's purposes of settlement negotiations or litigation.
The analysis included a financial evaluation of the assets including an examination of the steps needed to reach an ultimate value. This evaluation included a time line for value achievement and an evaluation of the risk involved in the process. The conclusions reached within The Langhorne Company report represented the basis for a court approved settlement wherein the official Unsecured Creditors Committee and the debtor accepted the company's report and liquidation of the asset "as is". The settlement was approved by Bankruptcy Judge, Robert Mark.
